I don't know and can't see what the hoopla is all about. Is
this the result of the latest U.S.S.C. decision? I've heard
these arguments made before over that. But first of all, let me
state very clearly, the S.C. decision is in favor of all
Americans, rather than being against any particular few.
To see the problem one has only to realize that, as is above
stated, homosexuality is forbidden by the Bible. That means that
it is a religious taboo. Nor is a uniformly forbidden thing,
some religions do forbid it, while there are others that pay it
no attention at all. What that means is that to attempt to
enforce prohibitions against homosexuality would be to pass laws
that favor some religious views/beliefs over others.
It's always a bad idea to make laws of religious doctrine.
Laws should be made because everyone in our society has an
interest in prohibiting or ensuring a thing. To do otherwise
would be to set off on a course that leads to the ruination of
religious freedom.
This particular law was struck down based on it's implied
requirement that police would need to invade bedrooms and the
privacy of the nations citizens to enforce it. The supreme court
wisely judged that the greatest majority of people would not like
to have their bedroom activities recorded by official observers,
as would ultimately be needed to ensure fair application of such
laws. In short, they saw the law as unworkable and only
selectively enforceable. I think that's a pretty darned good set
of reasons to set a law aside.
